1. Agreement to These Terms

These Terms of Use govern access to and use of the Tales of Khassid website, the Aelorian Archives, and the associated pages, records, stories, images, files, downloads, and other materials made available through khassid.com (collectively, the "Website").

The Website is operated as part of the Tales of Khassid publishing project, created by Darnell Coates and published under the Aelorian Press name.

By accessing or using the Website, you agree to comply with these Terms to the extent permitted by applicable law. If you do not agree, you should discontinue use of the Website.

Additional agreements, licenses, and policies may govern particular content, purchases, community activities, or services, including:

The Khassid Authorized Roleplaying License (KARL).
The Website's Legal & Attributions notices.
The Privacy Policy.
Applicable product licenses and purchase agreements.
Any additional written permissions issued by the appropriate rights holder.

Where a specific license expressly permits an activity otherwise restricted under these general Terms, the specific license controls for that activity.

2. About the Website

The Aelorian Archives is an evolving creative and informational resource dedicated to the fictional world of Khassid and the broader Tales of Khassid project.

Its contents may include fictional histories, religions, deities, civilizations, species, characters, narratives, game materials, maps, artwork, music, setting documentation, and other original creative works.

The Archives constitute a developing body of material. Content may be revised, expanded, reorganized, corrected, withdrawn, or otherwise modified as the setting evolves.

Publication of material on the Website does not constitute dedication of that material to the public domain or abandonment of intellectual-property rights.

3. Permitted Personal and Community Use

Visitors are welcome to explore the Website for lawful personal, educational, informational, and non-commercial purposes.

Subject to applicable licenses, visitors may:

Read, browse, and reference publicly accessible material.
Share hyperlinks directing others to publicly available Website pages.
Discuss the setting, its stories, characters, and game materials.
Use permitted materials in private tabletop roleplaying games.

4. Intellectual Property and Ownership

Unless expressly identified otherwise, original creative expression published through Tales of Khassid and the Aelorian Archives is owned by Darnell Coates or used under appropriate permission.

Such expression may include original prose, narratives, character portrayals, fictional histories, dialogue, illustrations, maps, distinctive artistic designs, and other copyrightable materials.

Names, titles, logos, source identifiers, and branding associated with Tales of Khassid or Aelorian Press may also be protected under applicable trademark or other laws.

Certain materials may incorporate third-party works, licensed game rules, public-domain materials, or material whose protectability is limited by applicable law. These Terms do not claim ownership of such third-party material or of unprotectable ideas, facts, names, or game methods considered independently.

All rights not expressly granted by these Terms, KARL, an applicable third-party license, or other written permission are reserved by their respective rights holders.

No transfer of copyright or other ownership rights occurs merely because material is publicly accessible.

5. Reservation of Rights Regarding Artificial Intelligence

Aelorian Press expressly reserves all rights available under applicable law concerning the use of original Tales of Khassid material in artificial intelligence and automated content-processing systems.

Except where expressly authorized in writing by the appropriate rights holder or otherwise permitted by applicable law, original protected content from the Website may not be reproduced, collected, retained, processed, distributed, or exploited for purposes including:

Training, pretraining, retraining, or fine-tuning generative artificial intelligence models.
Creating or expanding machine-learning datasets, training corpora, or model-development libraries.
Developing artificial intelligence systems intended to imitate, reproduce, or commercially substitute for protected original creative expression.
Building commercial content-generation, synthetic-media, or automated publishing products using protected material.
Creating searchable collections or retrieval-augmented generation systems through unauthorized bulk extraction or retention of protected content.
Developing commercial databases, knowledge repositories, or similar products that reproduce or substitute for substantial protected portions of the Website.
Creating unauthorized reproductions, adaptations, or derivative works through automated systems.

This restriction applies regardless of whether the relevant system is described as generative AI, machine learning, a foundation model, an automated agent, a retrieval system, or another technology.

The use of artificial intelligence tools by Aelorian Press in its own creative or production processes does not constitute authorization for third parties to use protected Tales of Khassid material for their AI systems.

This section does not prohibit lawful personal use, authorized accessibility functions, permitted search indexing, or uses independently authorized under applicable law or a valid license.

6. Automated Access, Crawling, and Data Collection

Automated access to the Website is subject to these Terms, applicable law, and any technical restrictions published or implemented by the Website operator.

Unless expressly authorized, automated systems may not:

Scrape, harvest, mirror, or systematically reproduce substantial portions of Website content.
Conduct automated bulk downloading or collection of protected creative materials.
Circumvent authentication systems, paywalls, rate limits, or technical access restrictions.
Ignore applicable crawler exclusions or deliberately evade access controls.
Collect protected content for unauthorized commercial databases, AI systems, or competing archives.
Interfere with Website functionality, performance, security, or availability.

The Website may publish machine-readable crawler directives, including robots.txt, or employ additional technical access controls.

Such directives communicate the Website operator's access preferences and restrictions. They do not, by themselves, alter statutory rights or guarantee that unauthorized collection cannot occur.

Permitted Automated Activities

Ordinary search-engine indexing, accessibility technologies, security monitoring authorized by the operator, and technical services necessary to operate the Website may be permitted, provided they comply with applicable law and restrictions.

Permission to index publicly available pages for ordinary discovery purposes does not automatically grant permission to build AI-training datasets, retain extensive copies of protected creative material, or commercially exploit that material for unrelated purposes.

A service seeking authorization beyond these permitted activities must obtain appropriate written permission unless its activities are otherwise lawful.

7. Third-Party Platforms and External Links

Tales of Khassid and Aelorian Press may maintain accounts, profiles, pages, advertisements, storefronts, or other presences on external services, including social media, video platforms, search services, and commercial publishing platforms.

The existence of these relationships does not, by itself, constitute a license to access or exploit independently hosted original Website content.

In particular:

Linking to khassid.com does not independently grant rights to copy, retain, or commercially exploit its protected creative materials.
Maintaining a social media business or creator account does not represent an independent public offer to license the Website's protected content.
Publishing promotional excerpts, artwork, descriptions, or hyperlinks on an external service does not, by itself, constitute permission to reproduce unrelated material hosted on the Website.
Rights granted concerning material uploaded directly to a third-party platform do not automatically extend to every original work independently hosted by Aelorian Press.
A third party seeking broader rights to protected Website content should obtain express authorization from the appropriate rights holder, unless such rights already exist under applicable law or a valid agreement.

No permission to use protected Tales of Khassid material for AI training, dataset construction, commercial extraction, or other restricted uses should be inferred solely from the existence of external hyperlinks or associated social media accounts.

Nothing in this section purports to unilaterally modify or nullify the terms of a separate, valid agreement entered into by Aelorian Press or the applicable rights holder.

Any conflict involving such an agreement must be evaluated according to its actual language and applicable law.

8. Relationship to KARL and Other Licenses

The Khassid Authorized Roleplaying License (KARL) governs expressly authorized uses of original Tales of Khassid material by players, Dungeon Masters, creators, and community participants.

The Website's general Terms of Use do not eliminate or reduce permissions expressly granted by KARL for a particular activity.

Authorized tabletop gameplay, character creation, private campaigns, actual-play content, commentary, and related community participation may continue in accordance with the applicable license.

KARL does not grant rights beyond those expressly stated in that license.

Certain game materials may incorporate content made available under Creative Commons licenses, including the System Reference Document 5.2.1.

Those materials remain governed by their respective licenses. Nothing in these Terms restricts rights granted independently by an applicable Creative Commons license.

Where an individual work or resource carries its own clearly identified licensing terms, those terms control the licensed material and use.

9. Community Content and User Contributions

The Website may provide or link to community forums, comment areas, Discord communities, social media pages, surveys, newsletters, and other interactive spaces.

Visitors remain responsible for the material they submit or publish.

By voluntarily submitting material directly to an official Tales of Khassid community service operated or controlled by Aelorian Press, contributors represent that they possess the rights necessary to submit that material.

Unless separate terms apply, contributors grant Aelorian Press a non-exclusive, royalty-free permission to host, display, reproduce as technically necessary, moderate, and preserve their submissions for the limited purposes of administering and maintaining the relevant service and community.

Contributors retain ownership of their original submissions, subject to any rights previously granted to others.

Submissions made directly to independent third-party services may be subject to those services' separate terms.

Visitors should not submit confidential information, private materials, or works they are not authorized to share.

10. Prohibited Conduct

Visitors may not use the Website in a manner that:

Violates applicable laws or the lawful rights of others.
Infringes copyright, trademark, privacy, or other protected rights.
Misrepresents affiliation with or endorsement by Tales of Khassid or Aelorian Press.

Purchase of a digital product does not automatically transfer copyright ownership or grant unrestricted commercial rights to its contents.

The applicable product license determines the purchaser's authorized uses.

14. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Aelorian Press and the applicable Website rights holders disclaim warranties concerning accuracy, reliability, uninterrupted availability, merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes warranties or statutory protections that cannot lawfully be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Aelorian Press, Tales of Khassid, the creator, and associated contributors or service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Website.

This limitation includes claims involving lost profits, lost data, or business interruption, except where applicable law prohibits such limitations.

Nothing in these Terms limits liability that cannot lawfully be excluded or restricted.

16. Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold harmless the Website operator and applicable rights holders against third-party claims, reasonable expenses, and liabilities arising directly from their unlawful misuse of the Website, infringement of another person's rights, or material violations of these Terms.

This provision does not apply where prohibited by law and does not eliminate applicable consumer protections.

17. Restriction or Termination of Access

Aelorian Press may restrict, block, suspend, or terminate access to Website services where reasonably necessary to address:

Public availability, search-engine indexing, hyperlinks, third-party promotional activity, or participation in external online platforms shall not, standing alone, be construed as a general license for unauthorized reproduction, dataset development, artificial intelligence training, or commercial exploitation of protected Website content.

Nothing in these Terms is intended to diminish lawful uses, public-domain rights, accessibility protections, or permissions expressly granted under KARL or other applicable licenses.

Tales of Khassid and the Aelorian Archives are creative properties associated with Aelorian Press.
